Our general terms and conditions of sale
Scope of application:
The general terms and conditions of sale (hereinafter "GTC") apply to all legal acts concluded in our Photo Grancy stores in Lausanne and Photo Riviera in Vevey and on our website.
The two shops and the website (hereinafter "Shops") are managed by the company Photo Riviera Sàrl at Avenue de la gare 13, 1800 Vevey in Switzerland.
GENERAL TERMS AND CONDITIONS OF SALE AND DELIVERY OF OUR SHOPS:
Conclusion of the contract
Ordering products or booking services from our stores by the customer by telephone, letter, email, online form or any other means of communication constitutes a firm request for the customer to enter into a contract.
Upon order confirmation, the customer acknowledges having read and accepted these General Terms and Conditions of Sale without reservation. Photo Riviera Sàrl reserves the right to modify these terms and conditions at any time.
Order and acknowledgment of delivery conditions
All orders placed with our stores imply unreserved acceptance of these delivery conditions. Any deviation from this rule must be subject to our written agreement.
Delivery times
The delivery times provided are for informational purposes only and do not constitute a firm commitment on our part. No compensation, penalty, or order cancellation will be possible in the event of a delay.
In-store pickup
The display information relating to the availability of a product in our branches is provided for informational purposes only and may contain errors (stock synchronization, simultaneous sale in store, internal transfers, ongoing inventories, etc.).
Even if in-store pickup is indicated at the time of ordering, Photo Riviera Sàrl cannot guarantee the immediate availability of the product at the chosen branch.
In case of unavailability when the client arrives:
– a transfer from another stock point may be offered,
– an equivalent alternative may be suggested, or
– the order can be cancelled and refunded.
No compensation, indemnity or penalty may be claimed in the event of inability to collect in store or additional delay in making the item available.
Deliveries and transfer of risk
Deliveries are made at the recipient's risk. Any damage related to transport must be immediately noted with the carrier and reported in writing to our services as soon as possible.
Shipments are only insured at the express request of the recipient and at their expense.
Claims and returns
Claims regarding delivery errors, quantity discrepancies, or immediately noticeable defects must be made in writing within 7 days of receiving the goods. After this period, we reserve the right to refuse any claim.
In the event of a delivery error attributable to our services, return shipping costs are covered by our stores. However, any order error made by the customer is their sole responsibility (including costs and risks).
All returns must be authorized by our stores beforehand and requested within 7 days of receipt. Returns are reviewed on a case-by-case basis. No right of return for personal convenience is guaranteed.
A product can only be returned if it is:
– new, complete and unused
– returned in its original packaging, accessories included, in perfect condition
– accompanied by proof of purchase
After verifying the returned product, we will proceed with the refund or exchange.
No returns or refunds are accepted for the following products:
– consumables (films, chemicals, photographic paper, inks…)
– memory cards, batteries and similar accessories
– software
– products ordered specifically at the customer's request (out-of-stock items, personalized items…)
Order modifications or cancellations after the contract has been concluded are only valid if confirmed in writing by our stores. Any costs already incurred may be charged to the customer.
Laboratory work
For development, digitization, printing or any other image processing services, Photo Riviera Sàrl acts exclusively as a technical service provider.
Films and media provided by clients may contain defects or damage beyond our control. The client is solely responsible for the integrity of the digital files and films submitted to our services.
We keep the negatives for a maximum of 30 days after they are made available. Once this period has expired, they will be destroyed without notice and without any possibility of making a claim.
In the event of damage, loss, mishandling or technical fault occurring during processing, Photo Riviera Sàrl's liability is strictly limited to the reimbursement of the price of the service concerned.
No compensation will be given for the value of the images, whether artistic, emotional, heritage or commercial.
We cannot guarantee exact color reproduction due to variability in the source file.
Backing up files
The client is responsible for performing their own backups. We do not guarantee the preservation of generated files (scans, photos, etc.). These may be deleted without notice after the service has been delivered.
No guarantee of artistic result
Any service involving creative judgment (retouching, correction, color grading, etc.) is performed according to professional photography standards. No specific artistic result can be guaranteed.
External causes
We cannot be held responsible for any losses, alterations or damages related to, in particular:
– hardware or computer failure
– electrical fluctuations
– viruses, file corruption
– external causes or force majeure
Submitting films or files to our services implies, in effect, unreserved acceptance of these specific conditions of the laboratory.
Guarantee
The warranty period is individually stipulated by the brand of the product purchased. As a general rule, it is two years.
For used items, the warranty is a maximum of 3 months.
Warranty exclusion
Any warranty service is excluded if the damage was caused by external influences, shocks, liquids, humidity, sand, extreme temperatures, mistreatment, incorrect handling or handling not in accordance with instructions.
It is also excluded if:
– the batteries leaked
– there was intervention by unauthorized persons
– non-original spare parts or accessories were used
Components subject to wear and tear (batteries, seals, screens, coatings, etc.) are not covered by the warranty, except for obvious defects recognized by the brand.
Data responsibility
Photo Riviera Sàrl declines all responsibility in case of loss, alteration or deterioration of data present on hard drives, memory cards, phones or any other digital media.
It is the client's responsibility to perform backups before any technical intervention.
Procedures for coverage
All warranty claims must be accompanied by:
– proof of purchase
– the complete product including accessories and original packaging when required by the brand
We reserve the right to decide, based on the manufacturer's diagnosis, between:
- repair
- exchange
– refund of the product price (less any deductions for wear and tear)
No loaner equipment is guaranteed during the analysis or repair period.
Equipment buyback and recovery
The stores offer, as a service, trade-in or buyback offers for photographic equipment, new or used, presented by customers directly in store.
Any evaluation, estimate or takeover offer, whether made orally or in writing, is provided for informational purposes only, without obligation and does not constitute a firm contractual offer within the meaning of the Code of Obligations.
The buyback offer is subject to a complete verification of the equipment, its actual working condition, the presence of the required accessories, and market conditions at the time of the transaction.
Photo Riviera Sàrl reserves the right to modify, correct or withdraw any takeover offer, particularly in the event of a manifest error in evaluation, price error, technical error or incomplete information provided by the client.
No buyback or trade-in contract comes into being until the transaction has been definitively concluded, either by the actual payment of the agreed amount, the issuance of a voucher or the actual allocation of the trade-in towards the purchase of new equipment.
Until that moment, no contractual obligation binds Photo Riviera Sàrl.
Price and VAT
All prices shown on our website and in our stores are in Swiss francs (CHF), including VAT.
Any delivery charges will be billed separately and indicated separately during the ordering process.
Payment terms
Orders are paid for using the payment methods offered during the ordering process.
The order is considered firm only after confirmation of payment.
No discount is given for early payment.
In the event of non-payment or suspicion of fraud, Photo Riviera Sàrl reserves the right to suspend or refuse any order.
Product availability
We strive to keep our product listings up-to-date. However, if an ordered product is unavailable, we reserve the right to:
– to cancel the order and proceed with the refund of the amount paid, or
– to offer the customer a replacement product of equivalent quality
Delays may occur beyond our control.
Limitation of liability
Photo Riviera Sàrl declines all responsibility for direct or indirect damages related in particular to:
– to the use or inability to use our website or our services
– to an interruption, breakdown or temporary unavailability
– to the use, malfunction or incompatibility of the delivered products
– to inaccurate information, errors or delays beyond our control
– to actions or failures of third parties (carriers, manufacturers, external service providers…)
Our liability is strictly limited to the amount of the order in question, except in cases of gross negligence or willful misconduct duly proven on our part. Product images appearing in advertisements, brochures, the online shop, etc., are for illustrative purposes only and are not binding.
No compensation will be given for:
– intangible or indirect damages (loss of profit, loss of business, commercial or emotional harm)
– loss or corruption of data, digital files or personal content
– consequences related to misuse or use not in accordance with product instructions
The use of the site and associated services is the sole responsibility of the client.
Language
In case of discrepancies between different language versions of these General Terms and Conditions, the French version shall prevail.
For legal purposes
The legal venue for all disputes is in Vevey, VD.
